Please read these terms carefully before using our services

Welcome to ConstructionExecs. These Terms of Service ("Terms") govern your access to and use of the website www.constructionexecs.com (the "Site") and the recruitment services provided by ConstructionExecs ("we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
1. Definitions
- "Candidate" refers to an individual who creates an account or submits an application to seek employment through our recruitment services.
- "Client" or "Employer" refers to a company or individual who engages ConstructionExecs to recruit candidates for open positions.
- "Executive Search" refers to the consultation-based premium recruitment service where a dedicated ConstructionExecs recruiter manages the full hiring pipeline on behalf of a Client, governed by a separate recruitment agreement.
- "Talent Signal" refers to the self-service job posting subscription service available to Employers, offered on a monthly or annual billing cycle.
- "User" refers to any person who accesses or uses the Site, including Candidates, Clients, and visitors.
- "Services" refers to the recruitment, job matching, job posting, and related services provided by ConstructionExecs through the Site.
2. Eligibility
You must be at least 18 years of age to use the Site and our Services. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Site on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration
To access certain features of the Site, you may need to create an account. When registering, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate.
- Keep your password secure and confidential. You are responsible for all activity that occurs under your account.
- Notify us immediately at inquiries@constructionexecs.com if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
4. Acceptable Use
The Site and Services are intended for professional recruitment use only. You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Submit false, misleading, or fraudulent information, including on resumes or applications.
- Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
- Scrape, crawl, or use automated tools to extract data from the Site without our prior written consent.
- Upload or transmit viruses, malware, or any harmful code.
- Attempt to gain unauthorized access to any part of the Site, its servers, or connected systems.
- Use the Site to send unsolicited communications (spam) or for any purpose unrelated to legitimate recruitment activities.
- Violate any applicable local, state, national, or international law or regulation.
5. Candidate Services
By submitting a job application or resume through the Site, you acknowledge and agree that:
- Your resume and application information will be processed through our Applicant Tracking System (ATS) and may be shared with prospective employers (Clients) for the purpose of evaluating your candidacy.
- When you upload a resume, we may use automated parsing technology to extract structured data (such as your name, contact information, work history, education, skills, and certifications) to pre-fill your profile and application forms. You can review and edit all extracted data before submission.
- We collect job search preferences you provide, including salary expectations, commute distance, construction division, software proficiency, and certifications, to better match you with relevant opportunities.
- ConstructionExecs acts as a recruitment intermediary and does not guarantee employment or placement.
- You are solely responsible for the accuracy and completeness of the information you submit.
- We may retain your resume and profile data in our recruitment system for future job matching opportunities, as described in our Privacy Policy.
- You may save or favorite job listings for later review. Saved job records are associated with your account and can be removed at any time.
- When you apply for a position, we may use automated technology (including AI-assisted tools) to compute a compatibility score between your profile and the job requirements. This score helps our recruitment team and employers assess fit, but it does not replace human review. All hiring decisions are made by people.
6. Client / Employer Services
By creating a Client account or engaging our recruitment services, you acknowledge and agree that:
- ConstructionExecs will conduct executive-level recruitment searches on your behalf based on your specified requirements.
- All candidate information shared with you (including through Talent Signal applications and Executive Search engagements) is confidential and must be used solely for evaluating candidates for the specific position(s) for which they applied or were submitted. You may not use, store, share, repurpose, or transfer candidate data for any other hiring need, internal database, or business purpose without our prior written consent.
- You will not contact, solicit, or otherwise engage candidates sourced through ConstructionExecs outside of the agreed-upon recruitment process without our written consent.
- Placement fees, terms, and conditions are governed by separate agreements between your company and ConstructionExecs.
6.1 Executive Search Engagements
Executive Search engagements are governed by a separate recruitment agreement that sets out fee terms, retainer amounts, guarantee periods, and non-solicitation obligations. Agreement documents may be generated and delivered electronically. Retainer invoices are processed through Stripe. You may upload signed agreement documents through your account portal. Placement details (candidate name, salary, start date) are recorded upon a successful hire.
6.2 Talent Signal Job Postings
Employers with a Talent Signal subscription may submit job postings, edit or delete drafts, discontinue live postings, and optionally display their company logo on the public listing. All postings are subject to content review (see Section 7.5).
6.3 Employer Applicant Access
Employers using Talent Signal may view applications submitted to their job postings, including candidate names, contact information, resumes, cover letters, project lists, and compatibility scores generated by our automated matching technology. Employers may update application status for their own tracking purposes. All candidate data must be kept confidential and used solely for evaluating candidates for the posted position.
7. Talent Signal Subscriptions and Payments
7.1 Subscription Plans
Employers may purchase a Talent Signal subscription to post job listings on the Site. Subscriptions are available on a monthly ($500/month) or annual ($5,000/year) billing cycle. Pricing is subject to change; any changes will apply to new subscriptions or renewals after the effective date of the change.
7.2 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By purchasing a subscription, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your credit card information on our servers.
7.3 Auto-Renewal
Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled before the renewal date. You will be charged the applicable subscription fee at the start of each billing cycle. We will send a payment confirmation email for each successful charge.
7.4 Cancellation
You may cancel your Talent Signal subscription at any time through the "Manage Billing" button on your My Jobs page, which redirects to the Stripe customer portal. Upon cancellation, your job posting will remain live until the end of the current paid billing period. After that, the posting will be removed from the public job board. No prorated refunds are issued for partial billing periods.
7.5 Content Review and Moderation
All Talent Signal job postings are subject to review before appearing on the public job board. This review may include automated content screening (using AI-based moderation tools to detect prohibited content such as hate speech, violence, or scam indicators) followed by manual staff review when necessary. We reserve the right to reject or remove job postings that violate these Terms, contain misleading information, or are not legitimate employment opportunities. If a posting is rejected, you may edit and resubmit it for review.
7.6 Refund Policy
Because Talent Signal subscriptions provide immediate access to our job posting platform, refunds are generally not available. If your job posting is rejected and you are unable to submit an acceptable replacement, you may contact us to discuss your options. We reserve the right to issue refunds or credits at our sole discretion on a case-by-case basis.
8. Automated Technology and AI
We use automated technology, including artificial intelligence (AI) and machine learning, to enhance our Services. These tools are used to:
- Resume parsing: Extract structured data from uploaded resumes to pre-fill application and profile forms. You can review and edit all extracted data before submission.
- Candidate-job matching: Compute compatibility scores between candidate profiles and job postings based on factors such as job title relevance, skills, experience, location, and salary alignment. These scores assist our recruitment team and employers in evaluating fit but do not replace human judgment. All hiring decisions are made by people.
- Job description analysis: Extract structured tags (skills, certifications, seniority level) from job descriptions to improve search and matching accuracy.
- Content moderation: Screen employer-submitted job postings for prohibited content before publication.
- Bot protection: We use Google reCAPTCHA v3 on certain forms to detect and prevent automated abuse. reCAPTCHA collects hardware and software information (such as device data, application data, and interaction events) and sends it to Google for analysis. By using these forms, you agree to Google's Privacy Policy and Terms of Service.
Automated tools are used to support, not replace, human decision-making. No application is automatically accepted or rejected solely by an algorithm. If you have questions or concerns about our use of automated technology, please contact us.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, page layout, and software, is the property of ConstructionExecs or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
The ConstructionExecs name, logo, and all related trademarks are the exclusive property of ConstructionExecs. Nothing in these Terms grants you any right to use our trademarks.
Candidate profiles, match scores, search results, talent pipelines, and all data compiled, generated, or maintained within our recruitment systems remain the property of ConstructionExecs. Access provided to Clients through Talent Signal or Executive Search engagements is a limited, non-exclusive license to evaluate candidates for the specific hiring engagement and does not transfer ownership of any candidate data, profile, or derived insight.
10. Third-Party Links and Services
The Site may contain links to third-party websites, services, or resources (such as LinkedIn, Calendly, or external job boards). These links are provided for your convenience only. We do not endorse or assume any responsibility for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk and subject to their respective terms of service.
11. Disclaimer of Warranties
The Site and Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, ConstructionExecs disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Site will be uninterrupted, error-free, or free of viruses or other harmful components.
- Any job posting, candidate profile, or other information on the Site is accurate, complete, or current.
- The results obtained from the use of the Services will meet your requirements.
12. Limitation of Liability
To the maximum extent permitted by applicable law, ConstructionExecs and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Site or Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability exceed the amount you paid to ConstructionExecs (if any) in the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless ConstructionExecs and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Site or Services.
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Any content or information you submit through the Site.
14. Termination
We reserve the right to suspend or terminate your access to the Site and Services at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Site ceases immediately. Sections 9, 11, 12, 13, and 16 shall survive termination.
15. Changes to These Terms
We may revise these Terms at any time by posting the updated version on this page and updating the "Effective Date." Your continued use of the Site after the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review this page periodically.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Douglas County, Georgia, and you consent to the personal jurisdiction of such courts.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire Agreement
These Terms, together with our Privacy Policy and California Privacy Notice, constitute the entire agreement between you and ConstructionExecs regarding your use of the Site and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
